Terms

The rules, in language you can actually read.

Short, specific, and free of the paragraph that says we can change everything without telling you.

The shop is not open yet. Artsby is still finalising its printer, so nothing on the site can be ordered today. This policy is published in advance so it can be read before it matters rather than after.

Who you are dealing with

Artsby is run by Cathy in Adelaide, South Australia. Contact is hello@artsby.com and it reaches a person.

Prices and orders

  • All prices are in Australian dollars and include delivery within Australia.
  • An order is an offer to buy. It is accepted when we send the confirmation email, and at that point the print goes into production.
  • If we have made a genuine pricing error — a decimal point in the wrong place — we may cancel and refund rather than honour it. We will tell you why, in plain terms, and we will not do this over a few dollars.
  • Colours shown on screen are an approximation of a printed sheet. The returns page explains this properly and it is worth reading before you order.

Artwork we made

The artwork in the Artsby collection is ours. Buying a print buys you the print: hang it, give it away, sell the physical object on. It does not transfer the copyright, so it does not let you reproduce the image, print more copies, or use it in something you sell.

Artwork you generate

This covers the generation tool, when it launches.

  • What you make is yours to use. We claim no ownership of images you generate with our tool, and we won't sell them or put them in our catalogue.
  • Copyright in AI-generated images is genuinely unsettled, in Australia and elsewhere. We are not going to tell you that you own the copyright, because nobody can honestly promise that yet. What we can say is that we make no claim against you.
  • You give us just enough licence to do the job: permission to store the image briefly and send it to our printer so it can be printed and delivered to you. Nothing beyond that, and it ends when your order does.
  • You are responsible for what you put in. If you upload a photograph, you are confirming it is yours to use, or that you have permission. Photographs of other people's artwork, of copyrighted characters, or of people who have not agreed are not yours to print.

What we will not print

We will refuse and refund an order rather than print anything that sexualises children, depicts a real identifiable person without their consent, promotes hatred or violence against a group, infringes someone else's copyright or trade mark, or breaks Australian law. This is not negotiable, and we don't need to justify a refusal beyond pointing at this paragraph.

Using the site

The tools are free and there is no account to make. Don't scrape the site wholesale, don't try to break it, and don't republish our written pages as your own. Otherwise, use them as much as you like — including commercially. The palette from your own room is your palette.

Where we stand on liability

Our guarantees under the Australian Consumer Law cannot be excluded and we are not trying to. Where the law permits us to limit liability, our responsibility for a print is limited to replacing it or refunding it. We are not liable for consequential loss — a print arriving late for a birthday is a real disappointment but it is not a claim for the value of the birthday.

The tools are provided as they are. The planner does arithmetic and the matcher counts colours; both are careful, neither is a substitute for holding a tape measure against your own wall before you put a nail in it.

Changes

If we change these terms we will change the date at the bottom of the page, and any order already placed is governed by the terms as they stood when you placed it.

Law

These terms are governed by the law of South Australia.
